HIGH COURT Has Dismissed A Petition Seeking To Halt The Burial Of Former Prime Minister Raila Odinga, Ruling That The Applicant Failed To Prove Any Urgent Or Constitutional Reason To Delay The Process.
The Ruling Was Delivered On Thursday, October 16, By Justice Chacha Mwita, Who Stated That The Petitioner Did Not Provide Sufficient Evidence To Show That The Funeral Arrangements Were Against The Late Odinga’s Wishes.
“After Reviewing The Application, I Am Not Convinced Of The Urgency Or Merit Of This Matter,” Said Justice Mwita. “The Petitioner Has Not Demonstrated That The Burial Process Is Being Conducted Contrary To The Deceased’s Instructions — A Necessary Basis For This Court To Intervene.”
The Petition Had Been Filed By Michael Onyango Otieno, Who Argued That The 72-Hour Timeline For Odinga’s Burial Violated Kenya’s Constitution — Particularly Article 44, Which Protects Every Individual’s Right To Participate In The Cultural Life Of Their Community.
Otieno Had Asked The Court To Suspend The Burial, Claiming That The Rushed Timeline Infringed On The Rights Of Citizens Wishing To Pay Their Last Respects To A Man Who Played A Pivotal Role In Shaping Kenya’s Political Landscape.
Despite The Emotional Weight Of The Matter, The Court Found No Legal Grounds To Intervene In The Burial Plans, Effectively Clearing The Way For The Scheduled Funeral To Proceed Within The Proposed Timeframe.
