The Case Accuses The CHADEMA Leaders Of Violating A High Court Order Issued On June 10, 2025. That Order Stemmed From An Ongoing Civil Case Concerning The Equitable Distribution Of Party Assets, Being Heard Under Judge Hamidu Mwanga. The Defendants Were Barred From Engaging In Any Political Activities Or Using Party Resources Until A Final Ruling Is Made In The Civil Case.
During Today’s Court Session, The Prosecution Submitted A Flash Drive Containing Video Evidence Allegedly Showing Statements Made At Various Events And Platforms That Are Said To Violate The Court’s June 10 Order.
The Case Has Been Scheduled For Hearing On October 22, 2025, At 5:00 AM, After Being Filed Under A Certificate Of Urgency. The Court Also Directed The Applicants To Serve The Case Documents To All Remaining Respondents As Soon As Possible.
Meanwhile, The Defense Has Been Instructed To File A Counter Affidavit No Later Than October 21, 2025.
As Of Today, Only Three Respondents — John Mnyika, The CHADEMA Board Of Trustees, And The Party's Secretary-General — Had Officially Received Notice Of The Case And Appeared In Court Along With Their Legal Counsel, Mpale Mpoki And Hekima Mwasipu.
Respondents Yet To Be Served, And For Whom The Court Ordered Immediate Notification, Include: John Heche, Rose Mayemba, Brenda Rupia, Hilda Newton, Twaha Mwaipaya, And Gervas Lyenda.
