A Court in Tanzania Has Dismissed the Case Against Two Defendants in The Karia Koo Market Building Collapse Case

The Kisutu Resident Magistrate's Court has dropped and cleared two of the six people charged with 31 counts of manslaughter following a building collapse in Mchikichi and Congo Streets, Kariakoo. This happened because the Director of Public Prosecutions (DPP) decided not to go ahead with those charges.

The two people who were cleared are the second defendant, Zenabu Islam, aged 61, who lives in Kariakoo, and the third defendant, Ashour Awadh Ashour, aged 38, from Ilala.

However, the first defendant, Leondela Mdete, 49, from Mbezi Beach, along with his three coworkers—Soster Nziku, 55, from Mbezi Beach; Aloyce Sangawe, 59, from Sinza; and Stephen Nziku, 28, from Mbezi Beach—were not dropped by the DPP, and the case continues.

The decision to drop the charges against the two accused was made today, Tuesday, December 30, 2025, by Senior Resident Magistrate Godfrey Mhini, who is handling the case.

Judge Mhini explained that the court made this decision after the DPP submitted a document stating it would not proceed with the charges against them.

Earlier, State Counsel Christopher Olembelle, supported by Neema Kibodya, informed the court that the DPP had filed a document under section 92 (1) of the Code of Criminal Procedure (CPA), 2023, indicating it would not pursue the case against the two accused.
